The Directorate for Legislation on the Justice System deals with preparation of the legislation and subordinate legislation (by-laws) in the field of justice system. This includes, inter alia, drafting of legislation and subordinate legislation in the field of organisation, status and jurisdiction of justice bodies (courts, judges, state prosecution, lawyers, notaries, etc.), criminal legislation (procedural and substantive), civil legislation (procedural and substantive), legislation in the field of protection of personal data, legislation on the Constitutional Court, legislation on co-operation with international criminal courts and tribunals and other related legislation as well as taking permanent care within the competences of the Ministry of Justice for harmonisation of legislation with legal acts of the European Union.
Other usual activities include in particular: preparation of drafts of responses of the Government and of the Ministry of Justice to the Constitutional Court of the Republic of Slovenia, providing opinions on drafts of legislation and subordinate legislation (by-laws) of other Ministries, co-operation with international organisations concerning drafting of legislation in states of Central and Eastern Europe, participation in committees of bodies of Council of Europe and bodies of European Union.
The "Mission" of the Directorate is of course a qualitative performance of its aforementioned competences, but in such a manner that due care is given permanently to protection of principles of constitutionality and legality, respect for human rights and fundamental freedoms from the Constitution of the Republic of Slovenia, legislation of the Republic of Slovenia and binding international treaties, as well the principle of proportionality is taken into account when legislative encroachments into human rights and fundamental freedoms are planned. The work at the Directorate in cases of major "constitutional" as well as legislative problems is as a rule in the shape of team work. The same manner is used when preparing positions concerning drafts of legal acts of European Union, of course in such a case with an additional emphasis on taking into account the legal system and legal tradition of the Republic of Slovenia, as far as possible.
